C&K’s practice focuses primarily on litigation in ERISA, estate planning, appellate practice, school employment law, insurance bad faith, and other negligence claims.

Insurance Coverage & Bad Faith

Don’t let the insurance company profit from your loss.  In Arizona, policy holders have significant protections against insurance companies who underpay, slow pay, or deny legitimate claims.  Litigation is never pleasant. Clients that find themselves at C&K are not here because they are being treated fairly by their insurance company. Insurance is a unique commodity – in exchange for money, an insured buys peace of mind. The insured counts on that peace of mind when catastrophic losses occur. Dealing with the loss is difficult on its own, when the loss is compounded by unfair, unreasonable claims handling, the client’s suffering is magnified.

C&K only knows one way to litigate an insurance claim – aggressively. From the claim to litigation, constant pressure must be applied to the carrier to justify its claims handling practices and treatment of insureds.

ERISA Benefit Litigation

The Employee Retirement Income Security Act of 1974 regulates all types of benefits provided by employers to employees. Everything from tuition assistance to pensions to disability benefits are covered by the statute. Counters & Koelbel focuses its practice in representing employees whose benefits have been denied. ERISA requires participation an administrative appeals process before you can bring your case to court. Counters & Koelbel represents employees in all stages of the process from administrative appeal to federal court appeals.

Civil Appeals

Counters & Koelbel has extensive background in representing clients in various courts of appeal. Lisa Counters’ success in appellate practice reaches back to law school where she participated in writing briefs for moot court competitions that in her second year of law school placed 10th in the nation. In her last year of law school, the ASU brief placed 2nd in the Nation. Together, Lisa and Kevin have successfully pursued appeals in all areas of civil practice. Employment Law

Arizona may be considered a "right to work" state, but that does not mean that employees have no rights. Counters & Koelbel has represented employees against employers whose rights have been violated by employers. Counters & Koelbel can also help negotiate employment contracts. The firm has extensive experience in representing teachers and school administrators in employment disputes.
